PROTEK FIBER TERMS OF SERVICE AGREEMENT

This Terms of Service Agreement ("Agreement") governs the use of internet services ("Service") provided by ProTek Fiber ("Company," "We," "Us," or "Our"). By subscribing to and using our Service, the customer ("You," "Your," or "Customer") agrees to the following terms:

1. SERVICE AGREEMENT

1.1 Acceptance of Terms – Your use of the Service constitutes acceptance of this Agreement. If you do not agree, you must discontinue use immediately.

1.2 Modification of Terms – The Company reserves the right to update or modify this Agreement at any time. 2. PAYMENT & BILLING

2.1 Billing – Service is billed on a monthly basis. Payment is due on the due date stated on Your invoice.

2.2 Late Payments – A late fee of $15 may be assessed for any overdue balance.

2.3 Non-Payment – If payment is not received within 20 days of the due date, the Company may suspend or terminate service.

3. ACCEPTABLE USE POLICY

3.1 Lawful Use – You agree not to use the Service for any unlawful, abusive, or fraudulent activity.

3.2 Prohibited Activities – The following activities are strictly prohibited: Engaging in illegal downloads, hacking, or unauthorized access to networks. Sending spam, phishing, or malware. Interfering with network security or performance. Harassing, threatening, or abusing Company employees or agents.

4. SERVICE TERMINATION

4.1 Termination by the Company – The Company reserves the right to suspend or terminate service with 48-hour notice for the following reasons:

•Non-Payment – Failure to pay within 30 days of the due date.
•Excessive Complaints – Repeated complaints about service that are deemed excessive, unreasonable, or abusive.
•Harassment – Abusive, threatening, or inappropriate behavior toward Company employees or agents.
•Policy Violations – Breach of any term of this Agreement or the Acceptable Use Policy.
•Service Abuse – Repeated actions that disrupt network performance or impact other users.
•Miscellaneous – Any other actions deemed inappropriate and/or acceptable for termination of service as determined by ProTek Fiber

4.2 No Refunds – Termination for cause does not entitle the Customer to a refund or proration of fees.

5. SERVICE AVAILABILITY & LIABILITY LIMITATIONS

5.1 No Guarantee – The Company does not guarantee uninterrupted Service. Outages, maintenance, or unforeseen technical issues may occur.

5.2 Limitation of Liability – The Company is not liable for damages due to service interruptions, data loss, or security breaches.

5.3 Indemnification – You agree to indemnify and hold the Company harmless from claims, losses, or liabilities arising from Your use of the Service.

6. SMS AND TEXT MESSAGING SERVICES

6.1 SMS Program – ProTek Fiber operates the ProTek Fiber Support SMS program, which provides customer support, technical assistance, service updates, and account notifications via SMS. Your consent to receive SMS messages is optional and not a condition of purchasing or using our internet services.

6.2 How to Opt-In – You may opt in to receive SMS messages from +1 (618) 207-3788 by:

•Texting one of our opt-in keywords (HELP, SUBSCRIBE, SUPPORT, TECH, or INTERNET) to +1 (618) 207-3788

•Providing your mobile number through our customer portal (https://portal.protekweb.com) or website with consent to receive SMS communications
•Initiating contact with our support team via text message
•When interacting with our AI support assistant (Emma) by phone, Emma may offer to send information such as WiFi credentials, payment portal links, or support details to your phone via SMS during the call

6.3 Message Frequency and Charges – Message frequency varies based on your service needs and account activity. Message and data rates may apply based on your mobile carrier's plan. ProTek Fiber does not charge for SMS messages, but your carrier may.

6.4 Opt-Out – You may opt out of SMS messages at any time by replying STOP to any message from ProTek Fiber. You will receive a confirmation message confirming your opt-out. You may also contact us at [email protected] or (618) 207-2545 to opt out.

6.5 Help – For help with SMS messages, reply HELP to any message or contact our support team.

6.6 Privacy and Data Protection – Your mobile phone number and SMS opt-in information will never be shared or sold to third parties, lead generators, or affiliates for marketing purposes. 6.7 Supported Carriers – SMS services are available on most major U.S. carriers including AT&T, Verizon, T-Mobile, and Sprint. Delivery and performance may vary by carrier.
